The legal landscape is changing.
On October 1, 2019, the prompt payment and adjudication regimes will change the way construction projects operate in Ontario. The Ontario Construction Lien Act will become the Construction Act as this name change reflects the broader scope of the legislation.
Not only has the Act been revised, but several entirely new sections have been added to the Act.
The adjudication process for Ontario’s construction industry has the potential to resolve payments in a timely fashion, but companies need to start preparing for the coming changes. To avoid costly missteps, one will need a clear understanding of the changes and practical guidance from industry experts to successfully navigate these new fast-track systems.
Regulations under the new Construction Act are pointing out that adjudicators must have at least 10 years of experience in the construction industry, for example, as an accountant, architect, engineer, quantity surveyor, project manager, lawyer or arbitrator.
